Terms of Service

These Terms of Service ("Terms") govern your access to and use of Shifted Dating ("Shifted", "we", "our", or "us"), including our website, mobile application, waitlist, support channels, premium features, and related services. By accessing or using Shifted, you agree to these Terms.

Eligibility

You must be at least 18 years old to use Shifted. By using Shifted, you represent that you are at least 18, that you have the legal right to enter into these Terms, and that you will comply with all applicable laws.

Dating and Safety

Shifted helps people discover and communicate with potential matches, but we do not guarantee matches, dates, compatibility, relationships, user conduct, identity, background, intentions, availability, or safety. You are responsible for your interactions with other users, including decisions to communicate, share information, or meet in person.

Use good judgment, protect your personal information, meet in public places, tell someone you trust about in-person plans, and contact emergency services first if you are in immediate danger.

Your Account

You are responsible for keeping your account credentials secure and for activity that occurs through your account. You agree to provide accurate information and to keep your profile reasonably current. You may not create an account for someone else, impersonate another person, or use Shifted if we have suspended or removed your account.

User Content

You are responsible for the profile information, photos, messages, reports, support requests, and other content you submit or send through Shifted ("User Content"). You represent that you have the rights needed to provide your User Content and that it does not violate these Terms or the rights of others.

You grant Shifted a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, transmit, and use your User Content as reasonably necessary to operate, improve, secure, moderate, and provide Shifted. This license ends when your User Content is deleted, except where retention is reasonably necessary for safety, legal, backup, support, or legitimate business purposes.

Moderation, Reports, and Enforcement

We may review profiles, messages, reports, support requests, account activity, and other information to operate the service, investigate safety issues, enforce these Terms, and protect users. We may remove content, limit visibility, disable features, suspend accounts, terminate accounts, or report conduct to appropriate authorities when we believe it is necessary or appropriate.

Premium Features and Subscriptions

Shifted may offer paid features, including Shifted+. Subscription availability, pricing, trial eligibility, renewal terms, and billing details are shown before purchase and may vary by region or platform. Purchases made through the Apple App Store are processed by Apple and are subject to Apple's payment terms.

Subscriptions may automatically renew unless cancelled through your Apple account settings before the renewal date. Shifted cannot cancel Apple subscriptions for you from inside our systems. Free trials, if offered, convert to a paid subscription unless cancelled before the trial ends. Refund requests for Apple purchases are handled by Apple according to Apple's policies.

No Guarantees

Shifted is provided on an "as is" and "as available" basis. We do not guarantee that the service will be uninterrupted, error-free, secure, available at all times, or that it will produce any particular match, date, relationship, result, or experience.

Intellectual Property

Shifted, including its name, branding, design, software, text, graphics, and other materials, is owned by Shifted or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or exploit any part of Shifted except as permitted by these Terms or with our written permission.

Account Deletion and Termination

You may request account deletion through the app where available or by contacting us. We may suspend or terminate your access if we believe you violated these Terms, created risk for other users, misused the service, or if we need to protect Shifted, our users, or third parties.

Third-Party Services

Shifted may rely on third-party services such as Apple, Supabase, Expo, Vercel, and other infrastructure, payment, hosting, analytics, communication, or support providers. We are not responsible for third-party services that we do not control.

Limitation of Liability

To the fullest extent permitted by law, Shifted and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, personal injury, emotional distress, or damages arising from user conduct, offline meetings, or your use of or inability to use Shifted.

Indemnity

You agree to defend, indemnify, and hold harmless Shifted and its owners, operators, employees, contractors, and service providers from claims, liabilities, damages, losses, and expenses arising from your use of Shifted, your User Content, your interactions with other users, or your violation of these Terms or applicable law.

Apple App Store

If you access Shifted through an Apple device or the Apple App Store, you acknowledge that Apple is not responsible for Shifted, our content, maintenance, support, claims, or third-party claims related to Shifted. Apple and its subsidiaries are third-party beneficiaries of these Terms as they relate to your use of Shifted through Apple platforms.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date and may provide additional notice through the app, website, or email. Continued use of Shifted after changes become effective means you accept the updated Terms.
